A premarital agreement may be challenged either at the time the parties to the agreement divorce or when one of them dies. There is a risk that the premarital agreement will not be enforced. At that time, circumstances may be quite different from what they are now. The law may change, or a party who was once wealthy may no longer be wealthy.
